Terms and Conditions of Service – Ali’s Surf School

These Terms and Conditions (“Terms”) govern your use of services provided by Ali’s Surf School (“we,” “us,” “our”). By booking a lesson, using our website, or participating in any of our services, you (“you,” “user,” “participant,” or “customer”) acknowledge that you have read, understood, and agree to be legally bound by these Terms, as required under applicable Canadian and North American laws.
1. Services
Ali’s Surf School offers surf lessons and related water sport instruction for individuals and groups. All services are subject to availability, weather conditions, and safety assessments.
2. Eligibility and Assumption of Risk
By booking or participating in our services, you declare that:
You are at least 19 years old, or have obtained parental or guardian consent if under 19.
You understand the activities are water-based and you are prepared accordingly.
You acknowledge and accept the inherent risks associated with surfing, including but not limited to injury, drowning, death, sun exposure, or collisions.
You agree to release and indemnify Ali’s Surf School, its owner, instructors, affiliates, and partners from liability to the extent permitted by Canadian provincial law and applicable U.S. law (including enforceable waivers in jurisdictions such as California or New York).
You are required to sign a Waiver of Liability and Assumption of Risk Agreement before participating.
3. Booking, Payment, and Cancellation
Booking & Payment:
Full payment or a deposit may be required to confirm your booking.
Payments are processed securely via third-party payment platforms compliant with PCI-DSS (Payment Card Industry Data Security Standard).
Cancellations by Customers:
More than 48 hours before the scheduled lesson: Full refund
Less than 48 hours before the lesson: Full refund minus 10$ admin fee
no-show: No refund
Cancellations by Ali’s Surf School:
We may cancel or reschedule lessons due to unsafe conditions, instructor unavailability, or force majeure (e.g., storms, government restrictions). In such cases, you’ll be offered a full refund or an alternative date.
4. User Responsibilities
By participating in our services, you agree to:
Arrive on time and follow all safety instructions provided by instructors.
Wear provided safety equipment (e.g., leash, wetsuit, flotation vest, if applicable).
Avoid reckless or endangering behavior during lessons.
We reserve the right to remove any participant who poses a danger to themselves, others, or the environment, without refund.
5. Limitation of Liability
To the fullest extent permitted by law in Canada and applicable U.S. jurisdictions, Ali’s Surf School:
Is not liable for any direct, indirect, incidental, special, or consequential damages arising out of participation in our services.
Does not guarantee specific outcomes (e.g., ability to surf independently) as progression varies by individual.
Limits total liability to the amount paid by you for the lesson in dispute.
This clause does not override any non-waivable consumer rights you may have under provincial or state law (e.g., Consumer Protection Act, 2002 [Ontario], Consumer Protection BC, or U.S. equivalents).
6. Personal Data and Privacy
We handle your data in accordance with:
The Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada
Any applicable provincial laws (e.g., Quebec's Law 25, BC’s PIPA)
U.S. state privacy laws such as the California Consumer Privacy Act (CCPA)

7. Intellectual Property
All content on our website, social media, and promotional materials—including logos, lesson content, photos, videos, and branding—remains the intellectual property of Ali’s Surf School. You may not reproduce or distribute this content without written permission.
8. Dispute Resolution and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, and, where applicable, relevant U.S. state consumer laws.
By using our services, you agree that any disputes will first be attempted to be resolved through good-faith negotiation. If unresolved, disputes will be submitted to the courts in Ucluelet, British Columbia or to a mutually agreed-upon arbitration service, depending on the nature of the claim.
9. Amendments to Terms
We reserve the right to change these Terms at any time. Updated versions will be posted on our website with the effective date noted. Continued use of our services after changes constitutes acceptance of the revised Terms.
